NO PURCHASE IS NECESSARY TO PARTICIPATE. MAKING A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. OPEN ONLY TO LEGAL RESIDENTS OF THE 50 UNITED STATES (INCLUDING THE DISTRICT OF COLUMBIA) WHO ARE AT LEAST 18 YEARS OF AGE AS OF THE DATE OF ENTRY. VOID WHERE PROHIBITED BY LAW.

PROMOTION DESCRIPTION: The Sumo Citrus® and The New Primal Sweepstakes (‘Sweepstakes’) begins on 2024-02-26, 12:00:00 P.M. PST and ends on 2024-02-29, 11:59:59 A.M. PST (the ‘Promotion Period’).

The sponsor of this Sweepstakes is Sumo Citrus (‘Sponsor’). By participating in the Sweepstakes, each participant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Sponsor, which shall be final and binding in all respects. Sponsor may be reached by email at [email protected] during the Promotion Period.

ELIGIBILITY: The Sweepstakes is open only to legal residents of the 50 United States (including the District of Columbia) who are at least 18 years of age as of the date of entry. The Sweepstakes is not open to employees or independent contractors of Sponsor, ChuckJoe, Inc. (“Administrator”) or any of their respective parent companies, subsidiaries, affiliates, advisors, or advertising/promotion agencies (all of the foregoing, collectively, the “Sponsor Entities”) or to members of the immediate family (spouses, domestic partners, parents, grandparents, siblings, children, and grandchildren) or persons living in the same household as any such employees or independent contractors.

HOW TO ENTER: To enter the Sweepstakes, the entrant must, during the Promotion Period, follow @sumocitrus and @thenewprimal on Meta (Facebook and Instagram), TikTok and X; like the Sweepstakes social media post; and tag a friend/friends in the comments section of the Sweepstakes social media post (with each tag earning one entry) in accordance with the Sweepstakes rules. Each Meta (Facebook and Instagram), TikTok and X post must comply with all rules, policies, terms, conditions and requirements of Meta (Facebook and Instagram), TikTok and X, including without limitation the Terms of Use and the Community Guidelines. Entrants are prohibited from inaccurately tagging content or encouraging other users to inaccurately tag content in any Meta (Facebook and Instagram), TikTok and X post. All Meta (Facebook and Instagram), TikTok and X posts and comments submitted by an entrant for purposes of Sweepstakes entry are referred to collectively in these Official Rules as a “Submission.” Submitting a Submission during the Entry Period that contains the Hashtag constitutes acknowledgement of and consent to these Official Rules.

Automated or robotic Entries submitted by individuals or organizations will be disqualified. Internet entry must be made by the Entrant. If any entrant attempts to obtain more than the stated number of Entries by using multiple/different email addresses, identities, accounts, registrations, logins or any other methods, including, but not limited to, commercial Sweepstakes/sweepstakes subscription notification and/or entering services, Sponsor will have the right in its discretion to deem any or all of that entrant’s entries void and/or to disqualify that entrant. Final eligibility for the award of any prize is subject to eligibility verification as set forth below. All entries must be submitted and received by the end of the Promotion Period in order to participate. Sponsor’s database clock will be the official timekeeper for this Sweepstakes.

WINNER SELECTION: The Winner(s) of the Sweepstakes will be selected in a random drawing from among all eligible entries (each an “Entry”) received during the Promotion Period. The random drawing will be conducted within about 7 days after the Promotion Period by Sponsor or its designated representatives, whose decisions are final. Odds of winning will vary depending on the number of eligible Entries received.

WINNER NOTIFICATION: Winner(s) will be notified via Direct Message on the social media platform where they submitted their Sweepstakes entry within approximately 7 days. Potential Winner must respond to the Direct Message as directed by Sponsor within 48 hours of notification. Sponsor is not responsible for any delay or failure to receive notification for any reason, including inactive account(s), technical difficulties associated therewith, or Winner’s failure to adequately monitor any account.

Any winner notification not responded to within the specified time period or returned as undeliverable may result in prize forfeiture. The potential prize winner may be required to sign and return an affidavit of eligibility and release of liability, and a Publicity Release (collectively ‘the Prize Claim Documents’).

PRIZE: The prize is one [1] Sumo Citrus and The New Primal Sweepstakes Prize Package, which will include the following items: three [3] boxes of Sumo Citrus fruit with an approximate retail value (“ARV”) of $75.00 USD, one [1] Sumo Citrus Swag Kit with an ARV of $100.00 USD, two [2] The New Primal Samplers with an ARV of $40.00, two [2] The New Primal Snack Mate Samplers with an ARV of $50.00, one [1] The New Primal Gift Card with an ARV of $75.00, and one [1] The New Primal Swag Kit with an ARV $10.00. The ARV of one [1] Sumo Citrus and The New Primal Sweepstakes Prize Package prize, with shipping, is $260.00 USD. The total ARV of all prizes is $780.00 USD, based on the three [3] total prize(s) that will be awarded. There is a limit of one [1] prize(s) per entrant. Substitution, assignment or transfer of a Prize is not permitted, except by Sponsor, which reserves the right to substitute a Prize or Prize component with another of equal or greater value. All other expenses associated with Prize acceptance or usage not specifically mentioned herein are the responsibility of the Winner(s). The prize is awarded “as is” and without any warranty, except as required by law. All federal, state and local taxes on the value of the prize are the responsibility of the winner. An IRS form 1099 will be issued if required by law.

META (FACEBOOK AND INSTAGRAM), TIKTOK, AND X:Sweepstakes is in no way sponsored, endorsed or administered by, or associated with, Meta (Facebook and Instagram), X, or TikTok.

GENERAL RULES: Sponsor and Administrator have the right, in their sole discretion, to modify these Terms and to cancel, modify, or suspend this Sweepstakes at any time in its discretion. If Sponsor or Administrator terminates the Sweepstakes, a notice will be posted on the Website. In such an event, Sponsor and Administrator reserve the right to award any remaining prizes in a manner deemed fair and equitable by Sponsor or Administrator. Sponsor and Administrator have the right, in their sole discretion, to disqualify or prohibit from participating in the Sweepstakes any individual who, in Sponsor’s or Administrator’s discretion, Sponsor or Administrator determines or believes has (a) tampered with the entry process or has undermined the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair practices; (b) engaged in conduct that annoys, abuses, threatens or harasses any other entrant or any representative of Sponsor or Administrator; or (c) attempted or intends to attempt any of the foregoing. The use of agents or automated devices, programs, or methods to submit entries is prohibited, and Sponsor and Administrator have the right, in their sole discretion, to disqualify any entry that it believes may have been submitted using such an agent or automated device, program, or method. All federal, state, and local laws and regulations apply. All entries become the property of Sponsor and Administrator and will not be verified or returned. These Terms may not be reprinted or republished in any way without the prior written consent of Sponsor or Administrator.

WAIVER AND RELEASE: To the fullest extent permitted by applicable law, each entrant releases and agrees to hold harmless each of the Sponsor Entities and all other companies involved in the development, operation, or marketing of the Sweepstakes or the provision of any prize or any component of any prize, and the successors and assigns of each of the foregoing, and Meta (Facebook, Instagram, and Threads), TikTok, and X, and the directors, officers, employees and agents of each of the foregoing (the “Released Parties”) from and against any and all claims, causes of action, and liabilities of any kind that the entrant ever had, now has, or might in the future have arising out of or relating to the Sweepstakes or use of any prize or any component thereof, including any and all claims, causes of action, and liabilities (a) relating to any personal injury, death or property damage, or loss sustained by any entrant or any other person; or (b) based upon any allegation of violation of the right of privacy or publicity, copyright infringement, misappropriation, defamation, or violation of any other personal or proprietary right. Each entrant agrees not to assert any such claim or cause of action against any of the Released Parties. Each entrant assumes the risk of, and all liability for, any injury, loss, or damage caused, or claimed to be caused, by participation in Sweepstakes, the use of any Sweepstakes-related website, or the provision, acceptance, or use of any prize or prize component.

LIMITATION OF LIABILITY: Sponsor assumes no responsibility or liability for, and is not responsible or liable for, (a) any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions; (b) any unauthorized access to, or loss, delay, theft, destruction or alteration of Entries; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, camera, computers or providers utilized in any aspect of the operation of the Sweepstakes; (d) inaccessibility or unavailability of any network or wireless service, the Internet or website or any combination thereof; (e) suspended or discontinued Internet, wireless or landline phone service; (f) any injury or damage to participant’s or to any other person’s computer or mobile device which may be related to or resulting from any attempt to participate in the Sweepstakes; or (g) any other technical, human or other error of any kind in connection with the Sweepstakes or the receipt or processing of Entries.

YOUR INFORMATION: By participating in the Sweepstakes, you agree that any personal information you provide in connection with the Sweepstakes is subject to Sponsor’s privacy policy available at https://sumocitrus.com/privacy-policy/ (“Privacy Policy”) and may be used as permitted pursuant to the Privacy Policy.

GOVERNING LAW AND DISPUTES: All issues and questions concerning the construction, validity, interpretation, and enforceability of these Terms, or the rights and obligations of entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California, U.S.A., without regard to conflicts of law principles of California or any other state. Any legal proceedings arising out of this Sweepstakes or relating to these Terms shall be instituted only in the federal courts of the Eastern District of California or the California state courts located in All entrants consent to the jurisdiction and venue of the federal, state, and local courts for Tulare County, California, and each entrant consents to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to any of the foregoing.
